DTI strengthens regulations on the importation of non-Philippine Standard (PS) certified vapor products
The Department of Trade and Industry (DTI) officially released Department Administrative Order No. 25-10 (DAO25-10) (2025) Regulating the Importation of Non-Philippine Standard (Non-PS) Certified Vaporized Nicotine and Non-Nicotine Products, and Novel Tobacco Products—ensuring that only products meeting the prescribed Philippine and international quality standards are allowed entry into the country.
DAO25-10 (2025) was issued pursuant to the DTI’s enforcement mandate under Republic Act No. 11900 (RA11900) or the Vaporized Nicotine and Non-Nicotine Products Regulation Act, Republic Act No. 4109 (RA4109) also known as the Standards Law, and Republic Act No. 7394 (RA7394) or the Consumer Act of the Philippines.
The policy clarifies and strengthens import controls for both commercial and non-commercial entries, including those made through e-commerce platforms, in line with Section 5 of Republic Act No. 11967 (RA11967) or the Internet Transactions Act of 2023.
The Order also supports the implementation of DAO22-06 (2022), as supplemented, which establishes mandatory product certification requirements. It also targets illegal importation and regulatory evasion, including products with illicit substances and those bypassing mandatory audit and testing.
By covering all entry channels—including e-commerce, freeports, air and seaports—the policy establishes a centralized, coordinated whole-of-a-government approach to regulation and enforcement.
The DTI urges all importers, travelers and e-commerce operators to comply with the new importation guidelines.
Violations may be reported to the DTI Office for the Special Mandate of Vaporized Nicotine and Non-Nicotine Products, Their Devices and Novel Tobacco Products (OSMV) via email at [email protected] or [email protected]. For consumer complaints involving vape products, individuals may register and file their concerns through the DTI Consumer Care System at ConsumerCare.dti.gov.ph.
